The development is contrary to:

• the sustainable development objectives of Tasmania's Resource Management and Planning System
• objectives and specific provisions of the (Tasmanian) State Coastal Policy 1996
• objectives to protect threatened species and habitats and specific provisions of the
  • Threatened Species Protection Act 1995 (Tas);
  • Environment Protection and Biodiversity Conservation Act 1999 (Cw); and
  • Fisheries (General & Fees) Regulations 1996
• objectives to retain areas of significance on the Register of the National Estate
• the stated priority of this State Government that the Regional Forest Agreement be adhered to (Schedule 9 of the RFA {Land Classifications} Act 1998 lists the Ralphs Bay Conservation area)
• findings and recommendations of the Tasmanian State of the Environment Report 2003
• recommendations and purpose of the Derwent Estuary Programme, established under a joint governmental Partnership Agreement
• provisions of the National Charter for Integrated Land Use and Transport Planning 2003 (Cw and Tas)
